AXIOTAP PRODUCT WARRANTY
1stmarkets, Inc. (1stmarkets) warrants the AxioTap product against defects in materials and workmanship for a period of three (3) years from the date of original purchase ("Warranty Period").
1stmarkets, at its option, will (1) repair or (2) replace defective products at no charge, or (3) refund the purchase price of the product, if a defect arises and a valid claim is received within the Warranty Period. At its option, 1stmarkets will use new or refurbished replacement parts, or exchange the product to match the form, fit, and function of the original product.
Shipping and handling charge will apply to any repair or exchange of the product undertaken by 1stmarkets after the first one hundred and eighty (180) days of the Warranty Period.
Pursuant to this warranty, 1stmarkets warrants replacement products or parts against defects in materials and workmanship for ninety (90) days from the date of the replacement or for the remaining portion of the original product's warranty, whichever is greater. 1stmarkets replacement product becomes property of the customer upon exchange. Customers exchanged product becomes 1stmarkets' property when a refund is given.
EXCLUSIONS AND LIMITATIONS
This Limited Warranty applies only to the AxioTap products manufactured by or for 1stmarkets that can be identified by the AxioTap trademark, trade name, or logo affixed to it. This Limited Warranty does not apply to any non-1stmarkets hardware product or any software, even if packaged or sold with the AxioTap product. Non-1stmarkets manufacturers, suppliers, or publishers may provide a separate warranty for their own products packaged with the AxioTap product.
Software distributed by 1stmarkets under the 1stmarkets brand name is not covered under this Limited Warranty. Refer to 1stmarkets' Software License Agreement for more information.
1stmarkets is not liable for any damage to or loss of any programs, data, or other information stored on any media connected to the AxioTap product, or any non-1stmarkets product or part not covered by this warranty. Recovery or reinstallation of programs, data or other information is not covered under this Limited Warranty.
This warranty does not apply: (a) to damage caused by accident, abuse, misuse, misapplication, or non-1stmarkets products; (b) to damage caused by service performed by anyone other than 1stmarkets; (c) to a product or a part that has been modified without the written permission of 1stmarkets; or (d) if any 1stmarkets serial number has been removed or defaced.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. 1STMARKETS SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF 1STMARKETS CANNOT LAWFULLY DISCLAIM OR EXCLUDE IMPLIED WARRANTIES UNDER APPLICABLE LAW, THEN TO THE EXTENT POSSIBLE ANY CLAIMS UNDER SUCH IMPLIED WARRANTIES SHALL EXPIRE ON EXPIRATION OF THE WARRANTY PERIOD. No 1stmarkets reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1STMARKETS IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.
FOR CONSUMERS WHO HAVE THE BENEFIT OF CONSUMER PROTECTION LAWS OR REGULATIONS IN THEIR COUNTRY OF PURCHASE OR, IF DIFFERENT, THEIR COUNTRY OF RESIDENCE, THE BENEFITS CONFERRED BY THIS WARRANTY ARE IN ADDITION TO ALL RIGHTS AND REMEDIES CONVEYED BY SUCH CONSUMER PROTECTION LAWS AND REGULATIONS. TO THE EXTENT THAT LIABILITY UNDER SUCH CONSUMER PROTECTION LAWS AND REGULATIONS MAY BE LIMITED, 1STMARKETS'S LIABILITY IS LIMITED, AT ITS SOLE OPTION TO REPLACEMENT OR REPAIR OF THE PRODUCT OR SUPPLY OF THE REPAIR SERVICE AGAIN.
OBTAINING WARRANTY SERVICE
For product failure within the first thirty (30) days from ship date, 1stmarkets will supply an Advance Replacement. The customer is to notify the local representative office and provide original purchase order number, product description, and a brief description of the failure. Customer is to contact the local 1stmarkets representative office and request a Return Material Authorization (RMA). The number must be included on all shipping information. The failed unit must be returned to 1stmarkets in its original carton within thirty (30) days, or the customer will be invoiced at the original purchase price.
Equipment requiring repair under the Factory Warranty, from an Authorized Repair Facility, needs to be returned to the Repair Facility supporting that Geographical area. Customer is to contact the local 1stmarkets office and request a Repair Material Authorization (RMA) number and include this number on all shipping information.
For coverage after expiration of the Standard Warranty, 1stmarkets offers flexible programs to continue the Standard Warranty. Please contact 1stmarkets for a quotation to meet specific needs.
